Terms of Use

These terms govern your use of the LoadSentry mobile application (the “App”), published by 14652843 Canada Inc. (“we”, “us”). By installing or using the App you agree to these terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal or internal business purposes. The App, including its calculators, design, and content, is the proprietary property of 14652843 Canada Inc. You may not copy, modify, distribute, sell, sublicense, or reverse engineer the App, except where such a restriction is prohibited by law.

2. Professional-use disclaimer

LoadSentry is a professional calculation aid, not a substitute for professional engineering judgment. All results are estimates produced from the inputs you provide and from simplified engineering formulas. Before making any operational, safety, structural, electrical, financial, or purchasing decision, you must independently verify inputs, site conditions, equipment specifications, applicable codes and standards, and engineering requirements, and consult qualified professionals where appropriate. You are solely responsible for decisions made using the App.

3. No warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR ITS RESULTS WILL BE ACCURATE, COMPLETE, ERROR-FREE, OR SUITED TO YOUR CIRCUMSTANCES.

4. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 14652843 CANADA INC. AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING WITHOUT LIMITATION DAMAGES FOR DOWNTIME, EQUIPMENT DAMAGE, DATA LOSS, LOST PROFITS, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATING TO YOUR USE OF THE APP OR RELIANCE ON ITS RESULTS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM OR CAD $50. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

5. Your data

The App stores the facilities and values you enter locally on your device and transmits nothing, as described in our Privacy Policy. You are responsible for your device and for anything you choose to share using the App's share feature.

6. Updates and changes

We may update, change, or discontinue the App or any feature at any time. We may also update these terms; the effective date above will change when we do, and continued use of the App after an update constitutes acceptance. Material changes will be noted in the App's release notes.

7. Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute shall be brought in the courts of Quebec, district of Montreal.

8. General

If any provision of these terms is held unenforceable, the remaining provisions remain in effect. These terms are the entire agreement between you and us regarding the App.
